Having employees myself in previous positions, I witnessed first hand employees needing time away from their jobs due to legal matters that could have been resolved from simply obtaining advice from an attorney. My previous employees also spent more than one year making monthly payments for their legal fees. I had another position processing payroll for employees in three states. More than just a few had several garnishments. Some of these garnishments were not justified. Had the employees been able to have an attorney intervene and submit a letter on behalf of the employee the court ordered garnishment would not have been ordered. The employees explained that they were not granted time off to seek legal advice or to attend small claims court to explain their case. I would have provided Legal Shield to my employees if I had known that is was available.
Employers that offer Legal Shield to their employees not only help employees and their families, but also benefit from less time off from their employees. The stress from uncertainties adds to more time off, lessened productivity and lessened accuracy in the employees job functions. Many legal issues can be resolved with a phone call for advice and if needed an attorneys intervention on the employees behalf. This eliminates the need for employees to seek time off from their job, eliminates stresses, enabling employees to focus on their job function and allowing them to worry less and live more.
Do you drive a company vehicle? Do you own a company that has drivers? Do you lease vehicles to other firms? Do you lease vehicles from a leasing firm or dealership? Were there any contracts involved? Did you have an attorney help you with contracts or price negotiations? Have you been cited for a traffic violation? Have you been the victim of identity theft? Have you signed an employment contract?
Driving a company owned vehicle is not limited to Semi Trucks. Many company vehicles are a fleet of cars, vans, pick-up trucks, trucks with 5th wheels, trucks with heavy towing capacity’s, vans that tow, CNG trucks & vans, flex fuel vehicles, aquatic vehicles, RV’s, trailers, and other mobile units they tow, box trucks, refrigerator trucks, school busses, buses in general, pups/smaller than full size trailers, snowmobiles, agricultural vehicles and what they tow, & virtually any type of vehicle.
Driving or pulling one or more of these vehicles puts the driver at risk simply by operating one of these vehicles and being in traffic.
In the United States we live with a law-suit mentality throughout the states. Driver and company types are in a variety of categories such as: Local Drivers, Over the Road (OTR), Private, For Hire, Truckload (TL), less then truckload (LTL) could be pup/s small trailers connected (includes agricultural), or Bulk (liquid).
Driver types fall into a few categories: Company Driver which is an employee of a firm will be provided with a W-2, Owner Operator which will be provided with a 1099, Independent (will have their own DOT), and Union/Non-Union drivers.
Service van drivers are also at risk even if the vehicle weight does not require a DOT number. In the event of a tragic accident, everyone gets sued even the manufacture of what contents are in the trailer & or tank.
Liquids are especially vulnerable because the load shifts as the vehicle moves. If the liquid or gas is flammable there is an added risk for transporting, plus HAZMAT signage is required to be visible from the exterior.

IF YOU DO NOT KNOW WHO HAS YOUR BACKSIDE COVERED, THE TIME TO FIND OUT IS NOT AFTER YOU HAVE BEEN INVOLVED IN AN ACCIDENT.
CHANCES ARE IF YOU ARE A COMPANY DRIVER THE “COMPANY” YOU WORK FOR IS COVERED FIRST. JUST LIKE ACCIDENT SPECIALISTS ARE CALLED IN FOR GENERAL DRIVER ACCIDENT INVESTIGATION, RECONSTRUCTION AND DRIVER FAULT, IT IS MUCH WORSE WHEN YOU DRIVE A COMPANY VEHICLE.

DEFENSIVE DRIVERS HAVE COMMON CHARACTERISTICS
1. FORESIGHT TO RECOGNIZE HAZARDS IN ADVANCE
2. JUDGMENT TO DECIDE SAFEST ACTION
3. SKILL TO CARRY OUT ACTION
4. ATTENTIVENESS AT ALL TIMES
5. MAKING GOOD CHOICES
• EVERY 12 MINUTES SOMEONE DIES IN A MOTOR VEHICLE CRASH, EVERY 14 SECONDS AN
INJURY OCCURS AND EVERY 5 SECONDS A CRASH OCCURS. MANY OF THESE INCIDENTS OCCUR DURING THE WORKDAY OR DURING THE COMMUTE TO AND FROM WORK. EXPERTS ESTIMATE THAT MORE THAN TWO-THIRDS OF ALL ACCIDENTS ARE CAUSED BY DRIVER ERROR.
Chances are if you are a company driver the “Company” you work for is covered first. Just like accident specialists are called in for general driver accident investigation, reconstruction and driver fault, it is much worse when you drive a company vehicle even if the vehicle weight does not qualify for a DOT number or that a driver have a CDL license.
The carrier is protected 1st, and maybe not the driver/operator.
At best every driver needs a Commercial Driver Legal Plan. Some companies see the value of savings to their company and to their drivers and include the CDLP as a company benefit. Other companies do not justify the expense but will allow the drivers to purchase the coverage as a payroll deduction. And there are companies that believe if drivers want a CDLP they should seek out Legal Plan Brokers to acquire the CDLP on their own.
I am a Broker for CDLP, Group Plans, Health, Medicare, Life, Accident, Disability and several ancillary product lines. CDL drivers can sign up for a CDLP in the state they are standing in regardless of the Companies Home Base or regardless of the driver’s state of residency. Commercial Driver’s must be 18 years old or older. There is coverage in 48 States. Eligibility for a Legal Plan: Commercial Drivers must speak English. The CDLP covers member, spouse or significant other. There are three plans specific to Commercial Drivers. Additionally a family Plan is also an option.
